What are the benefits of trying alternative dispute resolution before litigation?

Very few businesses actively want to be involved in litigation - if something

that's seen is a necessary way of achieving an objective, rather than the

objective in itself. Litigation can be quite a burden to businesses,

particularly in larger cases - this is not only because legal fees can be very

costly, but also because of the management time required to oversee

instructing lawyers, collating documentary, evidence dealing with

witnesses, and so on. It can be hugely distracting, not to mention stressful.

Many businesses prefer to try to settle disputes before proceeding to court - and

this is what's often referred to as alternative dispute resolution, or ADR

for short. ADR can take many different forms, and the most appropriate will

depend on your particular circumstances, including the nature of the dispute.

Alternative dispute resolution is typically quicker and more cost

effective than proceeding to court. The processes are usually voluntary though -

so they work best when both parties acknowledge that there's a genuine

dispute and they both have a willingness to compromise.
